On Monday 6 December, the European Commission launched a public consultation, open until 10 January 2022, on a draft implementing regulation to update the EU rules on recycled materials and plastics in food packaging.
This Commission Regulation is scheduled for adoption in the first quarter of 2022. It is intended to repeal Commission Regulation (EC) No. 282/2008 on recycled plastic materials and articles intended to come into contact with food, which did not apply to all recycling technologies.
The draft regulation, which is open for public comment, establishes: - provisions for the appropriate assessment of non-PET (i.e. non-polyethylene terephthalate) materials; - clear obligations for operators and competent authorities; - transitional provisions.
The 2018 EU Plastics Strategy, adopted as part of the 2015 Circular Economy Action Plan, aims to expand recycling capacity and increase the recycled content of plastic products and packaging, but a high level of health protection must be guaranteed by ensuring that the recycled plastic is decontaminated.
