New Common Agricultural Policy is gradually coming into force

The new regulations on the Common Agricultural Policy (CAP) entered into force, on Monday 6 December, after the publication of the texts in the Official Journal of the EU (see EUROPE 12845/12).

The new CAP will apply starting the 1 January 2023. For the years 2021 and 2022, a transitional regulation is in place, bridging the gap between the current and new legislation.

As for the next steps, the so-called ‘secondary’ legislation, detailing the implementation of the new CAP, is currently being prepared.

The most urgent secondary acts will be adopted by the European Commission before the end of the year, with the remainder to be adopted in the first part of 2022.

The Commission has already formally presented, on Tuesday 7 December, two delegated regulations: - the first on additional requirements for certain types of intervention in the CAP strategic plans for the period 2023-2027; - the second concerning paying agencies and other entities, financial management, clearance of accounts, guarantees and use of the euro and its annexes.

Member States have until 31 December 2021 to submit their CAP strategic plans. The Commission will then assess them and provide its comments to the Member States. The Commission has six months to approve the plans as revised by Member States, if necessary, to be applied from the 1 January 2023, when the new CAP comes into force.
