09/09/2020 (Agence Europe) – The exchange of personal data with the United States is under fire. After the so-called ‘Schrems II’ judgment from the EU Court of Justice, it is now Switzerland’s turn to acknowledge that the level of protection surrounding the exchange of data from its territory to the United States is not adequate (see EUROPE 12529/2). This was the conclusion, on Tuesday 8 September, of the Federal Data Protection and Information Commissioner (FDPIC) in his annual review of the ‘Swiss-US Privacy Shield’ in the light of the ‘Schrems II’ judgment. The day before, the Council of Europe stressed that there is an opportunity to “strengthen the universal data protection framework” through a new international legal instrument. (SPj)
