The next EU-US negotiating session on a transatlantic agreement on access to e-evidence held by a service provider in criminal proceedings (see EUROPE 12187/2) will take place on 6 November.
The announcement was made by the Director General of the Justice Department at the European Commission, Tiina Astola, on Monday 14 October, to MEPs of the European Parliament's Civil Liberties Committee (LIBE). The objective is to make “real progress” before the meeting of European and American Ministers of Justice on 10 and 11 December, she said.
A first formal negotiation meeting took place on 25 September (see EUROPE 12337/27). The Commission has made it clear that its negotiating position is defined by the mandate of the EU Council (see EUROPE 12260/26) and that it depends on the evolution of the proposals on e-evidence during the legislative procedure (see EUROPE 12227/8).
For the time being, the discussions covered, among other things, the types of electronic evidence, criminal proceedings and data that could be covered by the agreement, as well as the workflows, competent authorities and data protection safeguards to be put in place.
