06/03/2018 (Agence Europe) – As part of the copyright rules reform, European Parliament shadow rapporteurs examined a new compromise amendment to reduce the value gap on 6 March (see EUROPE 11974). The text on the table proposes to amend article 13 in the draft directive to indicate that in the absence of a licensing agreement, digital platforms will have to take appropriate and proportionate measures, “that ensure that content that does not respect copyright or counterfeit content on their services is not available and that content that does not infringe the rules, must remain available”. It also explains that implementation of these licensing agreements or measures must not include a general obligation incumbent on the platforms to control information they transmit or store, in compliance with article 15 of the E-commerce directive (2000/31/EC).
