European co-legislators make progress on 'posted workers' directive

The EU level inter-institutional meeting on the posted workers directive on 4 December was rather “fruitful” according to the information we have received. The co-legislators appear to have found common grounds for understanding on the modalities for the single official national website required of member states and which focus on the constitutive developments and remuneration of the posted workers.

Negotiators from the Council of the EU and the European Parliament have made progress on the sanctions included in the directive and which must remain “proportionate” in cases where incorrect publication of the terms of the employment of the posted worker is attested. Nonetheless, a more concrete formulation is still expected, according to the information we have been given. Progress was made on the question of work in temporary employment agencies.

The question of long-term postings including the duration and “negative” list was discussed, as well as the European Parliament position on the collective agreements. It should be recalled that the European Parliament would also like to cover the non-universal collective agreements.

The next meeting will take place on 13 December in Strasbourg during the plenary session of the European Parliament. EUROPE has compared the respective positions of the Council and Parliament (see EUROPE 11890). According to one diplomatic source, the two main questions to be debated are certainly the extension of the legal base proposed by Parliament and the long-term work postings. (PH)
