Media law: Hungarian amendments under examination

Brussels, 11/02/2011 (Agence Europe) - The proposed amendments to the Hungarian media law, sent to the Commission on Thursday, indeed respond to the three concerns raised by the commissioner, Jonathan Todd, spokesman for Media Commissioner Neelie Kroes, said on Friday. He did not, however, give any indication at this point as to whether the amendments provided a satisfactory response. Budapest has been asked to provide clarification on the principle of balanced coverage of events, registration of the media and application of the law to media based in other countries of the EU - all points where Kroes does not believe the Hungarian law to be consistent with the directive on audiovisual services, the principle of freedom of establishment or, indeed, Article 11 of the Charter of Fundamental Rights on freedom of expression. The amendments are currently being examined by the staff of commissioners Kroes and Reding. Kroes' spokesman drew attention, too, on Friday to the limits on what the Commission can do, for example, on the independence of media regulatory authorities and their composition. Todd pointed out that the audiovisual services directive contained only one reference to the independence of the authorities, without any definite criteria on how to measure it. This was the deliberately vague provision sought by the Council when the directive was being adopted, and one which leaves member states with considerable room for manoeuvre. (S.P./transl.rt)
