Brussels, 02/02/2009 (Agence Europe) - On Friday 29 January, the European Commission concluded that the Luxembourg regime for the creation of the compensation fund in the framework of the electricity market organisation, which has undergone changes, is compatible with the rules of the EC Treaty governing state aid and, in particular, the guidelines concerning aid to environmental protection. The Commission opened a formal investigation because it had its doubts regarding the exoneration from contribution to the fund enjoyed by certain consumers and payments to producers of green electricity. It also raised questions over the possibility that imported green electricity could be treated in a way which is discriminatory compared to the handling of the Luxembourg product. However, Luxembourg has provided information allowing the Commission's doubts to be mollified, and has undertaken to make changes to its regime in the future. In particular, the exoneration from contributing to the compensation fund has been removed and compensation mechanisms have been brought in for imported green electricity.
