Advocate General rules average consumer is unlikely to confuse “Moblilix” mobile telephones with cartoon character “Obelix”

Luxembourg, 29/11/2007 (Agence Europe) - The advocate general, Verica Trstenjak, returned her conclusions, on 29 November, in the case C-16/06 P, between publishing house Albert René (France) and the Office for Harmonisation in the Internal Market (OHIM). According to Ms Trstenjak, OHIM was within its rights to authorise the registration of the brand name Mobilix, against the opposition from the publishing house that produces the cartoon adventures of Asterix and Obelix.
