07/11/2007 (Agence Europe) - In a ruling published on Tuesday 6 November, the Court of First Instance rejected the complaint lodged by Omega SA (Switzerland) against the Office for Harmonisation in the Internal Market (OHIM). Following a request from US company Omega Engineering Inc., OHIM refused Omega SA's request to register the trademark Ù OMEGA for product in Category 9 (watches, stopwatches and similar products) and Category 42 (computer design and development). Omega SA appealed to the Court of First Instance against OHIM's decision to try and have the trademark registered, but the Court agreed with OHIM that there was a danger of confusion among consumers between the Omega trademark in France for Category 42 products and the Omega trademark in the United Kingdom for Category 9 products.
