Incomplete responses from Italy, Bosnia-Herzegovina, Macedonia and Poland on “secret detentions and rendition flights”

Brussels, 01/03/2006 (Agence Europe) - In light of its investigation into possible illegal CIA activities in Europe, the Secretary General of the Council of Europe, Terry Davis announced on Wednesday that Italy, Poland, Bosnia-Herzegovina and Macedonia had provided incomplete, indeed, insufficient answers about flights and secret detention centres. In Strasbourg during a press conference for the publication of his report (based on Article 52 of the European Convention on Human Rights), Mr Davis stated, “Europe appears to be a happy hunting ground for foreign security services”. He added, “hardly any country, with the clear exception of Hungary, has any legal provisions to ensure oversight over the activities of foreign security services on their territory”. He said the same went for European air space, which the CIA used for transporting prisoners. According to Mr Davis, “Very few countries seem to have adopted any effective way to monitor who and what is transiting through their airports and airspace”. In this connection, the problems of diplomatic immunity create “considerable obstacles” behind which secret foreign agents frequently hid. Mr Davis averred that, “immunity cannot mean impunity”. He considers that exceptions existed with regard to immunity if torture was involved or “other serious violations of human rights such as forced disappearances”. He also declared that Italy, Hungary, Bosnia-Herzegovina, and Macedonia had “regrettably, missed the opportunity to provide adequate replies and dispel all doubts”. Mr Davis said that with regard to Poland he had simply been disappointed. Complementary information would be requested from Member States that had provided insufficient responses, as well as concrete proposals so that the shortcomings in the report would be rectified with a view to action at a Council of Europe level.
