Why Wanadoo should receive disciplinary action in Brussels

Brussels, 16/02/2004 (Agence Europe) - As Wanadoo challenges before the Court of First Instance the fine of EUR 10.3 million that the European Commission imposed on it on 16 July 2003 for abuse of dominant position, and as its competitors, AOL and Tiscali, referred the matter to the French competition authority, "Le Figaro économie" summarised in its Monday's edition the reasons that have led the European Commission to take this decision. The French newspaper publishes broad extracts from a 160-page document that the Commission has not yet published. The Commission thus considers that the France Télécom subsidiary has benefited from preferential conditions for accessing information on eligibility of telephone lines to broad band technology. It considers, the newspaper goes on to say, that the technical support provided by France Télécom gives Wanadoo an advantage to which its competitors do not have access. The exclusive presence of Wanadoo offers in France Télécom agencies is a factor of a kind that confirms dominance. Finally, the Commission considers that Wanadoo would have envisaged the very large losses of high output internet very differently if it had not been able to integrate the benefits of the Yellow Pages in its accounting.
