Brussels, 13/02/2004 (Agence Europe) - Tuesday's Ecofin Council formally adopted without debate its common position on the proposed regulation on the creation of a European enforcement order for uncontested claims. This proposal aims to allow creditors who have obtained an enforceable judgement in respect of a claim which has never been contested by the debtor to have it enforced directly in other Member State, in order to ensure the free circulation of judgements, court settlements and authentic instruments in all Member States. It also aims to remove intermediate measures as a prerequisite for enforcement in another Member State of all decisions attained in the verifiable absence of any dispute by the debtor over the nature and extent of the debt. This common position will be sent to the Parliament for a second reading.
