On Thursday, 9 April, the European Commission published two regulations (one delegated act and one implementing act)—which aim to foster integrity and transparency in European energy markets—in the Official Journal of the EU.
The new delegated act focuses on the procedures for granting authorisation to, withdrawing [authorisation] from, and supervising entities that report energy market data to the Agency for the Cooperation of Energy Regulators (ACER). The intended goal is to ensure that the process for authorising and supervising these entities, also known as inside information platforms, is fair.
The implementing regulation is directly concerned with data reporting and how energy market data is reported to ACER. As the European Commission explains in a press release, [this regulation] aims to establish a “balanced” framework for transmitting data to market participants, “easing the reporting burdens of market participants where possible.”
The two acts will come into force this coming 29 April. They nevertheless provide for a transition period for applying most of the provisions so as to give market participants and other stakeholders time to adapt to the changes that have been introduced.
