European Court of Human Rights condemns Russia for illegal detention and degrading treatment of Aleksey Navalnyy

In a unanimous judgment handed down on Tuesday 3 February, the European Court of Human Rights declared that Aleksey Navalnyy’s conviction was a “flagrant denial of justice” and that the conditions in which he was detained seriously affected his life and health.

The Court found violations of the right to life (Article 2 of the European Convention on Human Rights), the right to liberty and security (Article 5 § 1) and the prohibition of inhuman and degrading treatment (Article 3).

It was of the opinion that the opponent’s conviction in 2014 was “based on an unforeseeable application of Russian criminal law” – which it had already stated in a judgment in 2017 – and that his detention was not “lawful”.

In addition, despite the fears expressed by the opponent after his poisoning in August 2020, the Russian authorities did not take into account his state of health in the conditions of his imprisonment, which has been determined to be inhuman and degrading treatment.

The Russian authorities have also ignored the interim measures ordered by the Court and the resolutions of the Committee of Ministers of the Council of Europe calling for his release.
