02/02/26 (Agence Europe) – On Monday 2 February, the European Union published the ‘REPowerEU’ regulation on the phase-out of Russian fossil fuels in the Official Journal of the EU, after the European Parliament and European ministers gave their final green light (see EUROPE 13794/14). However, the Hungarian and Slovakian authorities have announced that they are taking their case to the Court of Justice of the European Union, rejecting the legal basis for the ban (without going through a sanctions regime) and fearing for the energy security of their respective countries. On X, the Hungarian Minister of Foreign Affairs, Péter Szijjártó, confirmed that he had taken legal action on Monday 2 February. On the Slovakian side, the process is still underway, we have learned. A statement from the European Commission was also published concerning its intention to present a regulation dedicated to the remaining imports of Russian oil at “the beginning of 2026”.
