Twenty-four hours after the European Commission ordered the platform to retain all data relating to its AI (see EUROPE 13782/7), X restricted access to its image generation tool. From now on, only premium users (with a paid subscription) can use this feature.
X does not specify whether this change follows European reactions to sexual images generated without consent (see EUROPE 13779/14).
The Commission says that it has “taken note” of the changes, but that “this doesn’t change our fundamental issue”. “We don’t want to see such images. We don’t want users to be able to generate illegal content, and the question is how this is even possible in the EU”, insisted the Commission on Friday 9 January.
On Friday, X began to remove certain images that had been reported, although it had not announced that it was directly tackling the source of the problem. While the EU does not directly require the removal of certain content, it does oblige the platform, through the obligations of the Digital Services Act (DSA), to ensure that its design and systems do not allow the generation of illegal content.
