05/03/2025 (Agence Europe) – On Wednesday 5 March, the European Commission opened a call for evidence on the guidelines it is due to publish in January 2026 on the implementation of the regulation against unfair foreign subsidies (FSR). The main aim is to clarify the concept of “distortion” in relation to foreign subsidies. This will give clarity to companies, which currently rely on the interpretation of existing legislation, such as that on state aid or mergers. The guidelines will also have to specify the European Commission’s power to request notifications in the case of mergers or foreign subsidies received in a public contract, which fall below the notification thresholds of the FSR.
