EU Council adopts position on additional procedural rules for application of GDPR

On Thursday 13 June, the Council of the EU adopted its position on the regulation establishing additional procedural rules for the application of the General Data Protection Regulation (GDPR), specifically in cases of cross-border cooperation.

This regulation is intended to specify the roadmap to be followed when a data protection issue requires cross-border handling. This is the case, for example, when the complainant resides in a Member State that is different from that of the company being investigated.

The position adopted by the EU27 simplifies the harmonisation of admissibility conditions for cross-border action and adds the option to not apply all the additional rules when a case is deemed to be “simple and straightforward”, so that national authorities can “act swiftly on non-contentious cases”.

Member States, like the MEPs, also want to speed up investigation procedures and response times.

The details of the regulation must now be negotiated by the EU Council and the European Parliament, which already adopted its position last April (see EUROPE 13389/13). (Original version in French by Isalia Stieffatre)
