27/11/23 (Agence Europe) – On Monday 27 November, the EU Council formally adopted the regulation on fair access to data (Data Act) (see EUROPE 13289/13). The text, which was approved by MEPs at the last plenary session, provides for users of connected devices to have access to the data they generate. They should also be able to switch cloud data processing providers easily. In addition, the text sets out a list of exceptional circumstances or emergency situations in which public sector bodies will be able to access and use data held by the private sector. Part of the text is also devoted to the protection of trade secrets, and a number of provisions are designed to prevent unfair contractual clauses imposed unilaterally by a company with a dominant market position on another company.
