European Banking Authority consults on preventing misuse of money transfers and certain crypto-assets

27/11/23 (Agence Europe)On Friday 24 November, the European Banking Authority (EBA) launched a public consultation on new guidelines aimed at preventing the misuse of funds and certain transfers of crypto-assets for money laundering and terrorist financing purposes. These ‘travel rule’ guidelines specify the measures that payment service providers (PSPs) and intermediaries, as well as crypto-asset service providers (CASPs) and intermediaries, must take to detect missing or incomplete information accompanying a transfer of funds or crypto-assets. The consultation is open until Monday 26 February 2024. The EU Council has adopted legislation governing crypto-assets: the ‘MiCA’ regulation aimed at regulating the market and the revision of the Transfer of Funds Regulation (TFR) (see EUROPE 13183/4).
