European Commission proposes a regulation to standardise technical requirements for approval of non-road machinery

On Thursday 30 March, the European Commission presented its proposal for a regulation to harmonise the technical requirements for the type approval of non-road machinery, such as cranes, harvesters and snowploughs, at the EU level.

With this text, the Commission wants to bring order to the multitude of existing legal frameworks which prevent end-users, such as contractors or construction companies, from using their non-road mobile machinery in different Member States.

The rules, which will lead to a reduction in the administrative burden, could result in savings of some €846 million for stakeholders over 10 years, the Commission says.

Eventually, manufacturers should be able to apply for roadworthiness approval only once, in one Member State, so that a machine can also be approved in the other 26 Member States.

Users, such as rental companies, could benefit from reduced compliance costs and more easily use and resell machines across EU borders.

The text also calls for harmonised rules for drivers to ensure high road safety standards throughout the EU.

Furthermore, regarding legal certainty, the Commission specifies that the proposal for a regulation “deals only with the most relevant technical aspects” and “proposes a simplified one-step procedure that is proportionate and takes into account the characteristics of non-road mobile machinery”.

Finally, provisions are also proposed to increase market surveillance, including through procedures aligned with those used in the wider EU product legislation framework.
