09/12/2022 (Agence Europe) – On Wednesday 7 December, the European Data Protection Board (EDPB) welcomed the General Court of the European Union’s judgment on the same day that WhatsApp’s action for annulment of a penalty issued by the Irish supervisory authority was inadmissible (see EUROPE 13079/26). The latter based its final decision on a binding decision of the EDPB and imposed a fine of €225 million on WhatsApp. In particular, the European Commission accused it of failing to meet its transparency obligations under the General Data Protection Regulation in respect of users and non-users of the service. WhatsApp has also challenged the decision in the Irish courts and, according to the General Court, in the context of this action, it can challenge the validity of the EDPB’s decision. It will then be for the Irish court to review the legality of the final decision. (TM)
