European Commission opens a feedback period to review electronic forms for public procurement

On Wednesday 17 August, the European Commission opened a feedback period until 14 September to amend the implementing regulation on standard forms used for publishing public procurement notices.

Specifically, the amendment relates to electronic forms (eForms), an EU “legislative open standard” for the publication of public procurement procedures and the collection of data by all public administrations in Europe - under implementing regulation 2019/1780. The regulation provides for voluntary use of these forms from November 2022 and mandatory use from October 2023.

This change is the result of evolutions in the public procurement domain, such as those brought about by the Clean Vehicles Directive, which set binding national targets for the procurement of clean vehicles, or the addition of new fields related to green procurement, a European Commission source told us. It responds to requests from stakeholders and Member States.

“eForms are at the core of the digital transformation of public procurement in the EU. Through the use of a common standard and terminology, they can significantly improve the quality and analysis of data”, the source added.

Properly implemented, the eForms will increase the ability of businesses and other organisations to find procurement notices, the source continued. They will also reduce the administrative burden for buyers, increase the ability of governments to make data-driven decisions about public spending, and make public procurement more transparent, the source concluded.
