10/02/2021 (Agence Europe) – The tax and banking obligations incumbent on “Accidental Americans”, under the American ‘FATCA’ law (US Foreign Tax Compliance Act), will be on the agenda for the meeting of EU Finance Ministers on 16 February. According to two sources, the Dutch Minister of Finance has in fact asked to bring this subject to the attention of his European counterparts as a 'miscellaneous' item. During its Presidency of the EU Council, Germany took up this topic and contacted those responsible for the US tax administration to discuss the extent of the problems faced by EU residents with dual nationality (see EUROPE 12625/35). At the European level, another aspect of the law that is currently being examined is also its compatibility with the European regulation on data protection (see EUROPE 12642/22). (MF)
