There will be no postponement of the implementation of the Posting of Workers Directive, which will therefore be applied, as planned, on 30 July next, according to a letter from the Commissioner for Jobs and Social Rights, Nicolas Schmit, addressed to BusinessEurope and seen by EUROPE on Monday 4 May.
The new provisions, in particular the switch from ‘minimum rates of pay’ to ‘remuneration’, remain essential to ensure adequate protection of posted workers and guarantee fair service provision, the Commissioner explained to BusinessEurope’s Director General Markus J. Beyrer.
“You will also recall that some Member States would have wanted to apply the new measures earlier than the transposition deadline, something that they are prevented from doing by the explicit clause”, he adds. And to conclude: “for all these reasons, the Commission does not intend to propose an amendment of Directive (EU) 2018/957 with the view of changing its date of transposition”.
The Commissioner assured that his institution was doing “everything possible” to support the Member States, through the Expert Committee on Posting Workers and its subgroup dedicated to the transposition of the Directive.
In mid-April, BusinessEurope had called on the Commission to postpone the application of the new rules on posting so as not to overburden economic operators who have to deal with the consequences of the pandemic (see EUROPE 12469/34). (Original version in French by Pascal Hansens)
