Negotiations between EU institutions on the re-use of public sector information are about to be concluded.
The co-legislators are expected to reach an agreement on Tuesday 22 January on this legislative text which aims to facilitate the creation of EU-wide information products and services based on public sector documents (see EUROPE 12009).
According to a document internal to the discussions (4-column table) dated 17 January, the main lines of this text have already been the subject of a temporary agreement.
The European Parliament had abandoned its idea of including private companies providing services of general interest in the scope of the future directive. In an effort to reach a compromise, it had been prepared to be satisfied with a recital encouraging "Member States to apply the requirements of the Directive to certain private companies" (Recital 15).
On the other hand, MEPs had obtained an exclusion of data held by public companies that are linked to activities directly exposed to competition and, therefore, exempt from procurement rules (Article 1(2)(b)).
At this stage, it seems that the question of the lists of thematic categories of high-value data and the instrument for updating them is not yet fully resolved (Article 13).
