04/10/2018 (Agence Europe) – Polish and Dutch media have reported that the Netherlands is the third member state, after Ireland and Spain, to delay the extraditions of Polish nationals to Poland due to doubts on the independence of Poland's judicial system. An Amsterdam court has thus given four weeks to the Polish judiciary to respond to the Netherlands' questions. At the end of July, when asked by Irish courts, the EU Court of Justice said that a member state can refuse to execute a European arrest warrant if it considers that the judicial system of the country making the request (in this case, Poland) is deficient and that the person concerned runs the risk of not having the right to a fair trial due to these deficiencies (see EUROPE 12070).
