Member states must not require companies wishing to move headquarters to another member state to enter liquidation

In a ruling issued on Wednesday 25 October in Case C-106/161, European Court of Justice (CJEU) judges said the freedom of establishment is incompatible with a national regulation forcing a company into liquidation if it wants to transfer its headquarters to another member state.
