EU loses Chinese fasteners case at WTO

Brussels, 06/12/2010 (Agence Europe) - China has won its first victory at the WTO, in its complaint against EU anti-dumping measures on Chinese exports of iron and steel fasteners (DS 397). The WTO Dispute Settlements Body (DSB), to whom Beijing referred the case in July 2009, concluded that the EU had acted in a way that was “incompatible” with the anti-dumping agreement and the 1994 GATT, and that it, therefore, had “nullified or impaired” benefits accruing to China under those agreements. The DSB called on the EU to comply with international trade rules on the measures where the decision had gone against it. The highly technical Chinese complaint related to the way the EU calculated the dumping of Chinese exports of iron and steel fasteners, which, in January 2009, led member states to adopt anti-dumping duties of between 26.5% and 85% for a period of five years. The two parties now have 60 days in which to lodge an appeal against the ruling delivered on Friday. The WTO is due in the near future to deliver a further judgment on the Chinese complaint against EU anti-dumping measures on exports of shoes. (E.H./transl.rt)
