Court overturns cartel ruling against Bolloré S.A.

Brussels, 04/09/2009 (Agence Europe) - The carbonless paper producer Bolloré has had the decision concerning its involvement in an illegal cartel cancelled, in a ruling of the Court of Justice on Thursday through September. The Court declared that the European Commission was mistaken in its condemnation of the company both for its direct involvement in the infringements and for its liability in the infringements committed by its wholly-owned subsidiary, Copigraph (joint cases C-322/07 P, C-327/07 P and C-338/07 P). The Court notes that Bolloré does not feature in the Commission's statement of objections as anything more than the parent company of Copigraph, meaning that Bolloré was unable to assert its right to defend itself against accusations concerning its direct behaviour on the market, as these accusations were not listed in the Commission's statement. This ruling overturns the previous judgement of the Court of First Instance, which had rejected the company's appeal on the grounds that the sum total of the fine would not have been affected by this dual liability.
