14/12/2007 (Agence Europe) - According to a Court of First Instance judgment of 13 December, the “pagesjaunes.com” internet address cannot be registered as a Community trade mark. American company Xentral LLC (formerly Prodis Inc.) applied to the Office for Harmonisation in the Internet Market (OHIM) for this registration, but OHIM rejected it, to avoid any confusion with the trade mark “LES PAGES JAUNES”. The Court agreed with this decision, given the similarity between the trade marks and services. The Court did not rule on the legality of the domain name, since internet addresses do not come under Community law on European trade marks. (C.D.)
