Brussels, 17/10/2006 (Agence Europe) - Following a ruling on 14 April 2005 by the Court of Justice, confirming that Greece had not transposed directive 2002/77/EC on the liberalisation of electronic communications within the required deadline, the Commission has sent Athens a reasoned opinion, calling on it to take the necessary national measures. If Greece fails to notify the Commission of the measures taken to comply with the ruling before the end of December, it could be referred to the Court for a second time and find itself liable to sanctions in the form of penalty payments. Greece, which, like every Member State, had to transpose the directive by 24 July 2003, is the only one which has yet to take the necessary measures. While the directive sets the principle of full market liberalisation, including for broadcasting services, the new law on electronic communications, notified on 14 February 2006, does not include them. On 10 April, the Commission sent a formal notice for failure to respect a Court decision, in line with the infringement procedures of the Treaty (Article 228). On 26 June, Athens gave assurances that a new law, covering broadcasting services too, would be implemented, but there has hitherto been no notification. (ab)
