Luxemburg, 02/06/2006 (Agence Europe) - In July, the European Commission will bring forward two proposals to continue to transfer air passengers' personal data to the United States, Commissioner Frattini said at a press conference on Friday. The first will denounce the current agreement, which was annulled by the European Court of Justice on 29 May, following an appeal by the European Parliament (see EUROPE 9201). The second will allow the introduction of a new draft agreement based on the same content, but on a different legal basis (see EUROPE 9202). If a new agreement was not in force by 1st October, “it will be a disaster for European citizens,” said Mr Frattini. The situation would, he said, cause legal uncertainty for data protection, leading to numerous individual complaints being lodged. Each airline company could be tempted to negotiate the transfer of data bilaterally with the American authorities, thus creating legal uncertainty which could lead to a reduction in individual rights. “We hope that a solution will allow us to move forward, otherwise we will have to consider a solution on a bilateral level,” said Austrian Interior Minister Liese Prokop.
