Microsoft has until end of month to propose measures ensuring remedies are implemented

Brussels, 24/05/2005 (Agence Europe) - Microsoft has one week in which to present initiatives that will allow it to apply correcting measures imposed by the Commission to remedy abuse of dominant market position, the spokesperson for Competition Commissioner Neelie Kroes warned. Microsoft, for its part, still says it is “working with the Commission to reach an agreement and to come into line with the March 2004 decision”. At that date, the Commission imposed an EUR 497 million fine on Microsoft and also condemned it to put on the market a version of Windows that is not associated with MediaPlayer, and placed it under the obligation to divulge any documentation on interoperability. This remedy remains the main stumbling block and the Commission doubts that rival companies will be able to acquire protocols of Microsoft data on the basis of sufficiently detailed technical documentation. According to the Commission, the measure aims to allow server manufacturers to create software that is compatible with Windows, but both parties have, for over two months, been unable to reach an agreement on information sharing, especially on the price of licenses, the content and the arrangements for access to protocols (EUROPE 8912). The Commission's patience will perhaps have reached its limit on 1 June, which could give rise to a new phase of confrontation. The spokesperson reiterated that if it were not satisfied, the Commission would set the procedure underway to impose daily fines. Such fines can account for up to 5% of the consolidated daily turnover at global level.
