Luxembourg, 25/01/2005 (Agence Europe) - At the end of the case on animal experiments and cosmetic products at the European Court of Justice, it was decided that Advocate General Geelhoed would submit his conclusions on 17 March.
France is calling for the recent Article 4 (b) introduced as part of the 2003 directive and 1976 directive on cosmetics. This provision bans the marketing of cosmetics when they contain ingredients obtained from animal experiments. It also bans the use of experiments in the manufacturing process of cosmetics. France considers that with the 2003 directive, Parliament and the Council failed to respect the requirement of legal certainty because they did not clearly define the scope of the new Article (b) which raised a number of sensitive questions. France explains that this uncertainly has a negative impact on companies seeking to compete on the international market.
