03/12/2004 (Agence Europe) - As it had announced, the association of independent music publishers has taken the Sony-BMG case before the Court of First Instance. Impala, which considers the merger of two major music publishers creates a collective dominant position, hopes the Commission's decision - which authorises this operation unconditionally (see EUROPE of 23 July) - will be cancelled. The association will seek to demonstrate that the Commission "made a series of errors of law, assessment and reasoning" during its investigation. Impala calls on the Court of First Instance to apply expedited procedure allowing for the dispute to be settled in less than one year.
