Commission could present proposal on small claims cases in November

Dublin, 23/01/2004 (Agence Europe) - Antonio Vitorino said in Dublin that the Commission could present a proposed framework decision to simplify the settlement of small claims cases by the end of the year, probably November. The European Justice Ministers confirmed their support for such a proposal, and stressed that "the aim is to avoid an overly expensive mechanism, whilst making sure that SMEs and individual have easy access to justice", said Michael McDowell. This instrument "will be useful in making citizens' lives easier", said Mr Vitorino. The debate also focussed on the setting of a minimum amount to define "small claims" concerned by the simplified procedures, whether there will be the obligation to be represented by a lawyer, and the option to use written procedures. The discussion was "very useful" to guide the Commission's work, said Antonio Vitorino, who announced that the Commission will consult civil society before presenting proposals.
