Brussels/Luxembourg, 11/10/2001 (Agence Europe) - The European Court of Justice Press Division signals that the Court has issued judgements whereby "refugees or stateless persons cannot claim payment of family benefits under Community law where they have travelled directly from a non-Member State and are in a situation having no factor linking them with Community law". The European Commissioner for Social Affairs, Anna Diamantopoulou, said that she greatly hoped that the ruling would allow the Council and Parliament to made progress in adopting the proposal to include all third country nationals in the scope of Directive 1408/71 on social security regimes. EUROPE points out, however, that the Court simply stated that the measures of Regulation 1408/7 never applied to people who have never moved within the Community.
