European Commission presents documents to support national transposition of Energy Performance of Buildings Directive

On Monday 30 June, the European Commission presented a delegated regulation, an implementing regulation, and a guidance document detailing several targeted themes to support EU countries in implementing the Energy Performance of Buildings Directive (EPBD) (see EUROPE 13415/27).

This revised legislation came into force on 28 May 2024 and must be transposed at national level by 29 May 2026.

The publication of these guidance documents comes on the day of the first meeting of the Housing Advisory Council, which aims to improve the sustainability and affordability of housing.

Delegated regulation. This regulation revises the methodological framework for ‘cost-optimal levels’ so that Member States can set cost-effective energy performance requirements for owners of (new and existing) buildings, taking account of specific national circumstances.

The first annex of this document indicates that the Member States must establish reference buildings for single-family buildings, apartment buildings, and multi-family buildings as well as office buildings, and that they must use the provided reporting template to communicate to the Commission the parameters taken into account for establishing the reference buildings.

Implementing regulations. This text establishes common models for the transfer of information from national databases to the European Building Stock Observatory so that the latter can receive comparable data to assess progress in the building sector throughout the EU.

Policy document. This text aims to facilitate the effective and practical implementation of the revised directive, taking into account the guidance needs expressed by the Member States and the Commission’s interpretation of the provisions.

The document, which includes 13 annexes, covers specific topics such as the definition of a fossil fuel boiler, the development of single points of contact, national roadmaps on limit values for the global warming potential (GWP) of new buildings, taking into account ambient heat in energy performance calculations, and the energy performance of transparent building elements.
