On Thursday 20 March, the European branch of the Lesbian, Gay, Bisexual, Trans and Intersex Association (ILGA-Europe) published its 2025 inventory of SOGIESC (sexual orientation, gender identity and expression, sexual characteristics) cases, listing major decisions and cases pending before the European Court of Human Rights (ECHR) and the Court of Justice of the European Union (CJEU) between 2010 and December 2024.
The inventory reveals an upsurge in cases relating to hate crimes and hate speech, as well as the rights of trans people. Emblematic cases include: Sabalic v. Croatia (2021), where the ECHR condemned the authorities’ ineffective response to a homophobic attack, and Mirin (CJEU, 2024), a landmark ruling on the recognition of gender in the EU.
Despite some progress, 30 “leading case” judgements have still not been implemented by the Member States.
Demonstrating the growing role of the CJEU in the protection of fundamental rights, this inventory helps to target the actions to be taken in court to advance the rights of LGBTI people in Europe. ILGA-Europe is therefore calling for increased pressure on governments.
