25/10/24 (Agence Europe) – On Thursday 24 October, Germans Gabriele Bischoff (S&D) and Dennis Radtke (EPP) submitted a written question to the Commission on access to justice for the European Works Council (EWC) of Verizon Ireland, which has refused to fund an expert for the EWC. The EWC challenged the decision, but the Irish Labour Court dismissed the case, stating that the EWC, as a collective, cannot pursue legal action under Irish law. “If an EWC, as a collective body, does not have the right of recourse to the Irish courts, how does the Commission consider that the rights under Directive 2009/38/EC can be enforced in Ireland?”, they ask. In 2022, the Commission asked the Irish government to ensure compliance with the legislation (currently under review) on EWCs. Will the Commission be “initiating infringement proceedings?”.
