European toys and daily products industry is concerned about increase in non-compliant products available on European market

More than twenty European industries and NGOs have published a joint statement to the European Commission warning of the massive influx of non-compliant products of foreign origin into Europe.

The signatories denounce the “loopholes” in the current “regulation and enforcement of online trade via online marketplaces”. These shortcomings and the massive arrival of potentially dangerous products are a risk both for the “environment” and for “European consumers”.

Specifically, the signatories are calling for an amendment to the Digital Services Act (DSA) to “recognise online marketplaces as economic operators”, so that they are held responsible for the compliance of the products they sell. They also want to introduce a new omnibus regulation “amending all relevant legislation“.

The signatories want to see “enhanced obligations for online marketplaces”, “improved product traceability” and “obligations to accurately verify [that] the information from traders selling on their platform meets EU product requirements (...) before they can engage with consumers”.

Last June, several dozen associations published an open letter denouncing the “unfair competition” and fraudulent practices of several foreign online sales platforms (see EUROPE 13436/23).
