05/03/2024 (Agence Europe) – On Monday 4 March, the Member States approved amendments to the EU legislation on waste electrical and electronic equipment (WEEE), which covers a range of products such as computers, refrigerators and photovoltaic panels. Following a 2018 CJEU ruling on the unjustified retroactive application of extended producer responsibility to waste from photovoltaic panels placed on the market between 13 August 2005 and 13 August 2012, the amendments clarify in particular that the costs of managing and disposing of waste from photovoltaic panels placed on the market after 13 August 2012 are the responsibility of the producer of electrical and electronic equipment. A revision clause - whereby the Commission must assess the need to revise the directive by 2026 at the latest - has also been introduced. (TM)
