01/02/24 (Agence Europe) – The European Audiovisual Observatory published, on Thursday 1 February, a report in which it considers that the lack of transparency in contractual relations should be curbed and the balance between the negotiating power of the various contractual partners re-established to ensure the proper functioning of the copyright market within the EU. According to the report, Member States continue to benefit from the flexibility allowed by the Directive on Copyright and Related Rights in the Digital Single Market (CDSM). The implementation of the part relating to the remuneration of authors and non-performing artists in the context of exploitation contracts is thus part of a “fragmented European legal context”, making it difficult to adjust contracts, to grant a new right of revocation in favour of creators and to submit disputes to an alternative dispute resolution procedure.
