12/07/23 (Agence Europe) – On Tuesday 11 July, US digital giant Amazon went to the EU General Court to challenge its designation by the European Commission as a ‘very large online platform’ under the Digital Services Act (DSA) (see EUROPE 13064/18). This designation would oblige the multinational to comply, from 25 August, with the stricter rules of this legislation, which applies to platforms used by at least 45 million monthly users in the EU. The company believes that it does not meet the criteria of the DSA, which it claims was designed for “very large companies of which the turnover is mainly derived from advertising, and which relay public expressions and disseminate information”. Amazon’s action follows that of Zalando, which also brought a case before the CJEU on 27 June for the same reason (see EUROPE 13211/44). (TM)
