12/07/23 (Agence Europe) – On Wednesday 12 July, following an in-depth investigation, the European Commission gave conditional approval for Broadcom’s planned acquisition of VMware, a software provider and supplier of computer components. The Commission considered that the transaction, as initially notified, could affect competition on the worldwide market for the supply of Fibre Channel Host-Bus Adapters (FC HBAs). The Commission has made its approval conditional on Broadcom’s full compliance with measures ensuring, in particular, that its competitor Marvell and any potential entrant have access to the interoperability application programming interfaces and tools necessary for the development and certification of third-party FC HBAs. Broadcom undertakes to separate the team working on its own FC HBAs from the team in charge of interoperability and certification processes and technical support for third parties and to ensure the protection of confidential information obtained during these processes.
