20/04/2023 (Agence Europe) – In a judgment handed down on Thursday 20 April, the Court of Justice of the European Union has condemned Poland for failing to fulfil its obligations under the Environmental Noise Directive (2002/49) to assess and manage environmental noise (case C-602/21). In particular, Poland has incorrectly transposed the Directive: - by providing that the obligation to adopt action plans in quiet areas, where noise limit values have not been exceeded, would only apply from July 2024; - by not providing that the action plans should include a description of the measures to be taken over the next five years to preserve these quiet areas. In addition, Warsaw failed to draw up action plans for 13 major rail routes and 247 listed major road routes within the set deadlines (Annex A of the judgment).
