02/12/2021 (Agence Europe) – The European Commission announced on 2 December that it had closed the infringement proceeding against Poland concerning the retirement regime for Supreme Court judges. The proceeding had been launched in July 2018. The retirement regime for Polish Supreme Court judges introduced in December 2017 was subsequently ruled discriminatory in June 2019 by the Court of Justice of the European Union, as it applied to sitting judges appointed before this law and gave discretionary power to the President of Poland to extend the period of judicial activity of judges of this court beyond the newly set retirement age (see EUROPE 12363/4). Poland has since amended its legislation by abolishing the disputed retirement regime. “Consequently, this matter has been resolved and the Commission therefore decided to close the case”, the institution said in a statement.
