05/07/2021 (Agence Europe) – On Sunday 4 June, the European Commission launched a public consultation on its future proposal to better fight the abusive use of shell companies, announced in its May Communication on company taxation and expected by the end of the year (see EUROPE 12720/15). In particular, it wants to collect figures and evidence on the use of fictitious entities and arrangements for tax evasion within the EU, in order to get an idea of the scale of the problem. The results of the consultation will also enable the Commission to develop a common definition of shell companies or FVCs and to determine the merits of a new European initiative. The Commission is also seeking the stakeholders’ views on the tax consequences that should be attached to shell entities, once they have been identified, as well as on the sanctions to be imposed.
